The Seekbooks Loyalty Programme ("the Programme") is operated by SeekMedia.com Pty. Ltd. ABN 54 087188494 ("Seekbooks"). Each member of the Seekbooks Loyalty Programme is bound by these Terms and Conditions.

Membership

1. Each application for membership of the Programme is subject to acceptance by Seekbooks at its absolute discretion.
2. Programme membership is only activated by valid registration accepted through www.seekbooks.com.au ("the Website") and is only available to individuals. Corporations, partnerships, trusts and other entities are not eligible to participate in the Programme.
3. Programme awards are only available to Active Members. A member becomes active on completion of their first purchase and remains active provided they make a purchase on the Website within 12 months of a prior purchase on the Website or otherwise withdraw from the Programme.
4. Any Loyalty Points or Award Certificates are forfeited if the member ceases to be an Active Member.
5. Each member, by virtue of their membership of the Programme consents to Seekbooks marketing product sold on the Website to them via email or other media.

Earning of Loyalty Points and Award Certificates

6. One Loyalty Point will be earned by Active Members for every whole dollar spent making an Eligible Purchase. Seekbooks may also offer bonus Loyalty Points from time to time on terms set by Seekbooks in its absolute discretion.
7. Eligible Purchases comprise all the purchases of product, excluding gift wrapping and shipping charges, made at the Website from the time you join the Programme except where the purchase is made under another promotion or discount or where the purchase is made via an affiliate offer, promotion or membership.
8. Loyalty Points are earned when an Eligible Purchase is completed and credited within 24 hours after the purchased product is shipped by Seekbooks. Loyalty Points cannot be transferred and are only redeemable by the member. Active members of the Programme can check their Points balance online by logging on to the Website.
9. An Award Certificate for $10 will be automatically issued by Seekbooks by email to Active Members for each 200 Loyalty Points credited to the members account. Award Certificates will be available for redemption as a credit against any purchase of product through the Website made before expiry of the Award Certificate. Award Certificates will expire 12 months after the date of issue.
10. Seekbooks will provide at least 90 days notification to Active Members of any change in the Award Certificate rules.
11. Any refunds to the member for product purchased at the Website will be debited against the members Loyalty Points balance.

Redemption of Award Certificates

12. Award Certificates are redeemable online at the Website at the rate of one Award Certificate per purchase. Award Certificates are redeemable by entering the Award Certificate voucher code at the check-out page at the time of purchase.
13. No change will be given for purchases valued at less than the face value of the Award Certificate and Award Certificates cannot be redeemed for cash.

Members Personal Information

14. Member's membership details are personal information for purpose of the Privacy Act. Personal information collected for the purpose of the Programme shall include name, address, email address and phone number but shall not include any personal financial information.
15. Personal information will only be used by Seekbooks for the purpose of administering the Programme and for promotion by Seekbooks to the individual member.
16. Seekbooks will not provide personal information to outside organizations except where contracted by Seekbooks to administer the Programme or provide promotional support to Seekbooks.
17. Member's user names and passwords will not be disclosed to any other person and Seekbooks employees and affiliates will not ask members for their password.

Termination

18. Seekbooks reserves the right to suspend or terminate the Programme at any time by providing at least 90 days notice to members.

19. Seekbooks may terminate any membership of the Programme without notice if the member: fails to comply with these Terms and Conditions; engages in misleading or deceptive conduct in connection with the Programme; dies or is declared bankrupt; or does not make an Eligible Purchase within 12 months of the preceding purchase.
20. A member may terminate their membership in the Programme at any time by giving written notice to Seekbooks.
21. All credited Loyalty Points will be forfeited on termination of a member's membership.

Administration

22. To the extent permitted by law, any liability that Seekbooks may have to a member relating in any way to the Programme whether for negligence, breach of contract or otherwise is limited: in the case of any claim relating to points, to crediting the relevant number of points to the member’s account; and in any other case, to a maximum of $0.05 for each point in the member's account at the time the liability arose.
23. All conditions and warranties whether express or implied and whether arising under statute or otherwise, are expressly excluded to the full extent permitted by law.
24. Seekbooks may make any changes to the Programme at any time in its absolute discretion, provided that it provides due notice to the member where so provided in these Terms and Conditions.
25. Any public notice required to be given by Seekbooks may be given by advertisement in the public notice columns in the major daily Sydney newspapers.
26. The Terms and Conditions of the Programme will be governed by the laws of New South Wales.
